What Housing Issue is on the Ballot in Peninsula?

Voters in Peninsula will see an advisory question on the November 3rd ballot asking whether the Village should prohibit short term rentals of fewer than 30 days when the property owner does not live on the property.

The Akron Cleveland Association of REALTORS® (ACAR) opposes the proposed prohibition.

Why does this matter to REALTORS®?

This issue goes beyond short term rentals. It raises an important question about how far local government should go in restricting the lawful use of private property.

Peninsula already has regulations governing short term rentals, including requirements related to permitting, occupancy, parking, insurance, safety and other operating standards. Rather than prohibiting an entire category of properties based on whether the owner lives on-site, ACAR believes the focus should remain on addressing specific problems and enforcing reasonable regulations.

A property owner who follows the rules should not lose a lawful property use simply because the property is not owner-occupied.

ACAR supports the Village’s ability to regulate issues such as noise, parking, safety and nuisance activity. However, regulations should address the problem, not eliminate the property use.

Restrictions on property use can affect property values, investment decisions and the choices available to future buyers and sellers.

ACAR believes Peninsula can protect neighborhood character while respecting property rights and maintaining reasonable options for property owners.

That balance matters for short term rentals and the broader real estate market.
